Military Lending Act Disclosure

Arbitration Clause; Notices: PLEASE REVIEW THE ARBITRATION CLAUSE AND NOTICES SET FORTH BELOW. BY USING THE NEXA CARDS CARD, YOU ARE AGREEING TO THE ARBITRATION CLAUSE. THE ARBITRATION CLAUSE WILL HAVE A SUBSTANTIAL EFFECT ON YOUR RIGHTS IN THE EVENT OF A DISPUTE.
This NEXA CARDS Cardholder Agreement ("Agreement") is a binding agreement between you and Issuer that govern your use of the card account. We reserve the right to amend this Agreement at any time.
Using Your Account and Card
You may use your Card for making Purchases and obtaining Special Offers. You agree to sign the Card immediately after you receive it. We are not responsible if someone refuses to accept your Card. You agree not to use the Card for any Internet gambling transactions or illegal transactions.
Statements and Billing Cycles
Your Statement will disclose important information about your Account, including transactions, payments, Fees, Interest Charges, and payment requirements. Billing Cycles are generally approximately 30 days but may vary slightly in length.
Lost or Stolen Cards
If you notice the loss or theft of your Card, write to us immediately or call us at +14136422333. You will not be liable for any unauthorized use that occurs after you notify us. Your liability will not exceed $50.
Credit Limits
Provided you maintain sufficient collateral to cover a Purchase, NEXA CARDS doesn't usually limit how much you can spend on your Account but sometimes NEXA CARDS may set a spending limit.
Interest Charges
We figure Interest Charges by applying a Daily Periodic Rate to an Average Daily Balance of each Balance Category. We will not assess Interest Charges during a Billing Cycle for any new Purchases made during that Billing Cycle if you pay the previous month's New Balance in full by its payment due date.
Making Payments
You are responsible for payment in full of all transactions and fees. You make a payment to NEXA CARDS through any means permitted by NEXA CARDS. Please allow at least five (5) days for postal delivery.
Collateral
Your linked wallet may provide the collateral that will secure charges made on any Card (the "Collateral"). The Collateral will be in the form of a digital asset. A "Liquidation Event" will occur if you fail to make payment within 21 calendar days or if the Market Value of your Collateral drops below the value of existing charges.
The Collateral will be owned by you at all times and held in your custody within smart contracts on Supported Blockchains. NEXA CARDS will only have access to the Collateral during or after a Liquidation Event.
FOR CONSUMERS: FOR YOUR CONVENIENCE, OUR SERVICE IS STRUCTURED TO INITIATE REPAYMENTS VIA PREAUTHORIZED TRANSFERS FROM A LINKED ACCOUNT, HOWEVER, NEXA CARDS DOES NOT CONDITION ITS EXTENSION OF CREDIT ON A CONSUMER'S REPAYMENT BY PREAUTHORIZED ELECTRONIC FUND TRANSFERS.
Account Default
We may consider you in default if: you do not make any payment when due; any payment is rejected; a Liquidation Event occurs; a bankruptcy proceeding is filed; you made false statements; or you permanently reside outside the United States.
Communications
We may contact you about your Account by mail, telephone, email, text message, or personal visit. We may use an automated dialing device and contact you at your home, place of employment, or mobile telephone.
Dispute Resolution and Arbitration
PLEASE READ THIS PROVISION VERY CAREFULLY. IT LIMITS YOUR RIGHTS IN THE EVENT OF A DISPUTE.
Binding Arbitration: You and NEXA CARDS agree that any and all past, present and future Disputes shall be determined by arbitration. Any arbitration shall not proceed as a class, group or representative action. This agreement shall be construed under the Federal Arbitration Act.
Arbitration Procedure: Before filing a claim, you agree to try to resolve the Dispute informally. The American Arbitration Association (AAA) will administer the arbitration under its Commercial Arbitration Rules. Arbitration will proceed on an individual basis and will be handled by a sole arbitrator.
Class Waiver: Any dispute will be conducted only on an individual basis and not in a class, consolidated or representative action.
No Jury Trial: If for any reason a claim proceeds in court rather than through arbitration, each party knowingly and irrevocably waives any right to trial by jury.

What To Do If You Find A Mistake On Your Statement:

- Within 60 days after the error appeared on your statement
- At least 3 business days before an automated payment is scheduled
What Will Happen After We Receive Your Letter:
- Within 30 days, we must tell you we received your letter
- Within 90 days, we must either correct the error or explain why we believe the bill is correct
Indemnity
You will indemnify and defend NEXA CARDS and Issuer against any claims, losses, damages, fines, penalties, liabilities, and expenses arising out of a breach by you of any representations, warranties, or agreements contained in these Card Terms.
